The Round – Terms & Conditions

These Terms and Conditions apply to your subscription to The Round (Modern Milkman Ltd’s membership subscription).

They supplement the Modern Milkman Terms of Service and Terms of Use for Website and Applications. Except as varied here, those terms continue to apply.

  1. THE ROUND

    1. The Round is a membership programme offered by Modern Milkman Ltd (“Modern Milkman”, “we”, “us”) providing opted-in customers unlimited delivery in exchange for a fixed, upfront monthly or annual fee (the “Round Fee”).
    2. At launch, The Round will be available only to selected customers. We may extend availability over time.
    3. Benefits. Depending on the plan (monthly or annual), members receive some or all of the following, non-exhaustive, list of benefits:
      • Unlimited Delivery on all Orders.
      • Birthday gift (coupon for 100% discount on one selected product, max qty 1).
      • Sign-up anniversary gift (coupon for 100% discount on one selected product, max qty 1).
      • Periodic discount reward on selected products (via automated member coupon).
      • Monthly gift lottery entry (pre-planned reward; separate promotion terms will apply).
      • We may introduce further member benefits or tiers over time.
    4. Changes. We may change The Round, its benefits, the Round Fee, or these Terms. Material changes will be notified via email or prominent notice in the Service (“Notification of Change”). Continued use after such notice constitutes acceptance. If you disagree, you may cancel (Section 9).

  2. ELIGIBILITY & AVAILABILITY

    1. Eligible Customers. You must: (a) be 18+; (b) hold a Modern Milkman account in good standing; and (c) primarily use The Round in the country of account registration.
    2. Channels. The Round will be available on our web and mobile applications.
    3. We may verify eligibility at any time and suspend/terminate if criteria are not met (Section 10).

  3. HOW TO SIGN-UP

    1. You may sign up: (a) during your first-purchase journey; or (b) from My Account → Membership.

  4. STARTER PACK

    1. For new customers who opt in during first purchase, the Starter Pack items are auto-added free. Existing customers who opt in can add these items free to their next order.
    2. Contents may vary by plan and availability; limits may apply (e.g., one Starter Pack per membership).
    3. We may substitute items of equal or greater value at our sole discretion.

  5. GIFTS & PERIODIC REWARDS

    1. Birthday & Sign-Up Anniversary Gifts. Birthday & Sign-Up Anniversary Gifts. We may periodically identify eligible products for gifts on your birthday (”Birthday Gift”). 7 days before your birthday, we will send you a unique coupon for 100% off one selected product (maximum qty 1), subject to availability and local restrictions.
    2. Periodic Discount Reward. Members may, from time to time and subject to our sole discretion, receive members-only pricing on selected products (via automated coupon). The frequency, value, and availability of any such discount is not guaranteed and may be varied or withdrawn at any time. First-time purchasers who subscribe to The Round may receive the discounted pricing on their first order if a reward period overlaps.
    3. Monthly Gift Prize Draw. Each month we shall select a member at random to receive a pre-planned reward. Each draw will be governed by separate published Promotion Terms including eligibility, entry route, closing date and prize details and will be communicated alongside each draw.

  6. DATA & PRIVACY

    1. When you subscribe to the Round, we will ask for: your date of birth (for birthday gift); household size and whether there are under-16s in the household (to shape relevant rewards); and allergens (to send samples safely).
    2.  We will process your data in line with our Privacy Policy (see our legal page). Where required, we will obtain your consent and provide appropriate controls.

  7. CANCELLATION BY YOU

    1. You can cancel any time via the Members screen (or as otherwise communicated).
    2. Effect of Cancellation. If you cancel:
      • Your benefits continue until the end of your current membership period;
      • No further Round Fees will be taken;
      • Membership fees are non-refundable except as required by law (see 9.3).
    3. Cooling-Off. You have a 14-day right to cancel from the later of sign-up or the start of the membership period. If you cancel within this period before any delivery has been made, we will refund the Round Fee in full. If one or more deliveries have been made prior to cancellation we will calculate deductions based on the value and number of the deliveries made, in accordance with UK consumer law.

      Nothing here affects your statutory rights.

  8. SUSPENSION, TERMINATION & FRAUD

    1. We monitor for fraud and abuse (e.g., improper voucher use, account sharing). If reasonably suspected, we may: (a) suspend or terminate your membership; and/or (b) suspend/deactivate your Modern Milkman account.
    2. If we terminate without your breach, we will refund you pro-rata for the unused portion of the current period. If termination is for breach/fraud, no refund is due.

  9. FEES, BILLING & RENEWAL

    1. Payment Method. Round Fees are charged to the saved payment method shown at sign-up (you can update it in My Account). The Round Fee appears as a separate transaction with its own receipt.
    2. Start & Renewal. Your first payment marks the start of your membership period (monthly or annual). Membership auto-renews at the end of each period unless cancelled (Section 7).
    3. Failed Payments. If payment fails and is not corrected promptly, we may cancel the membership with immediate effect; uncollected amounts remain due.
    4. Price Changes. We may adjust the Round Fee. Changes take effect on your next period. We’ll provide a Notification of Change in advance.
    5. Except for the Cooling-Off scenario in Section 7.3 or where required by law, fees are non-refundable.
    6. If you change from monthly to annual or vice versa mid-period, we will explain any pro-rata charges or adjustments before confirming the change.

  10. VOUCHERS, THIRD-PARTY & TIERED OFFERS

    1. We may provide vouchers, trial periods, or third-party offers (e.g., partner programmes). Each is subject to separate offer terms which you must accept.
    2. At the end of any free/discounted period, you will revert to your standard Round Fee unless you cancel beforehand.
    3. If multiple offers are applied, the most recent may replace the prior; unused time/benefits may be forfeited per the specific offer terms.

  11. TIERS

    1. We may offer monthly and annual plans, and/or additional tiers (e.g., different benefit bundles). Annual plans may include additional benefits versus monthly (as displayed in the Service).
    2. We may modify, substitute or remove tier benefits with Notification of Change.

  12. LIABILITY

    1. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot be limited under law.
    2. Subject to the above, we are not liable for: (a) losses not caused by our breach; (b) business losses or loss of profit for non-business consumers; (c) events beyond our reasonable control.
    3. Nothing in these Terms affects your statutory rights.

  13. GOVERNING LAW

    1. For UK customers, these Terms are governed by English law, and disputes are subject to the courts of England and Wales.
    2. If The Round is offered in other countries (e.g., the US), local terms and consumer rights may apply and will be provided at rollout.
